State Unemployment Taxes Rising
501(c)(3)s May Opt Out by Federal Law
On average, U.S. employers saw a 33% increase in unemployment taxes last year and will see another 16% increase in 2011. States have borrowed more than $48 billion to cover unemployment benefits - a cost that will be passed along to employers in the state unemployment tax system.
As a 501(c)(3), you can avoid these tax increases, as nonprofits have the exclusive right by federal law to opt out of the State Unemployment Tax (SUTA) system and only pay dollar-for-dollar when they have an unemployment claim.
Although this law has been in place since 1972, never before has it been more imperative for nonprofits to exercise this option. However, monitoring and protesting claims as they occur can be time consuming and may jeopardize assets if you don't have a reserve to pay claims.
A Colorado Nonprofit Insurance Agency and Colorado Nonprofit Association member benefit, the Unemployment Services Trust (UST) was formed by a group of nonprofits to help other nonprofits safely leave the state unemployment tax system. UST helps you build a reserve account to pay claims and protect cash flow. In addition, UST's expert claims representatives continually monitor claims for you and assist with court hearings, so you don't pay for unwarranted claims. Last year alone, this saved UST members $38.5 million by reducing inaccurate claims and state errors.
Nonprofits can opt out of their state tax system annually by giving notice to the state no later than November 30 (few state deadlines differ). On average, members who joined UST for 2011 saw an immediate savings of $99.74 per employee.
